Terms of Service

1. Introduction

Welcome to Genogram Pro. These Terms of Service ("Terms") govern your access to and use of the Genogram Pro application and website (collectively, the "Service") operated by Viston MB, a company registered in the Republic of Lithuania ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Account Registration

To use certain features of the Service, you must create an account. You may register using an email address and password, or through third-party authentication providers such as Google or GitHub OAuth.

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

3. Service Description

Genogram Pro is an online genogram creation tool that allows users to build, edit, and share family diagrams (genograms). The Service includes a free browser-based editor, paid subscription plans, and a limited free tier. New paid subscriptions may begin with a free trial period as described in Section 4. Features and limitations may vary between plans and may change over time.

4. Subscriptions, Free Trials, and Payments

Paid subscriptions are processed through Creem, which handles payment processing on our behalf.

  • New subscriptions may include a 7-day free trial. A valid payment method is required to start the trial.
  • If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method is charged at the then-current price.
  • Only one free trial is available per user. Returning subscribers who have previously used a trial will be charged immediately upon subscribing.
  • Subscription fees are billed in advance on a recurring basis according to the plan you select
  • You may cancel your subscription or trial at any time; access continues until the end of the current billing period or trial
  • Refunds are handled in accordance with our refund policy and applicable law
  • We reserve the right to change pricing with reasonable notice to existing subscribers

5. Data and Encryption

We take the security of your data seriously. Genogram Pro uses end-to-end encryption for genograms, templates, and shared content. Your data is encrypted on your device before it reaches our servers, and only you hold the decryption keys.

Please note that if you lose your master password, we cannot recover your encrypted data. You are responsible for securely storing your decryption credentials.

6. AI-Generated Content

The Service includes AI-powered features that can generate and modify genogram content. While we strive to make these features helpful, AI outputs may contain errors, inaccuracies, or omissions.

You are solely responsible for reviewing, verifying, and validating all content created or modified using AI features before relying on it for any purpose. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.

AI features are provided as productivity tools and should not be used as a substitute for professional clinical judgment.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload or transmit malicious code, viruses, or other harmful content
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for any fraudulent or deceptive purposes
  • Scrape, crawl, or use automated means to access the Service without our prior written consent
  • Resell or redistribute the Service without authorization

8. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Viston MB and is protected by intellectual property laws. You retain full ownership of any content and data you create using the Service. We do not claim any rights over your genograms or other user-generated content.

You grant us a limited license to store, process, and display your content solely for the purpose of providing and improving the Service.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or third parties. You may terminate your account at any time by contacting us or using the account deletion feature within the Service.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Viston MB and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, through email or an in-app notification. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania.
